My New Rental Terms & Conditions

Welcome to My New Rental, LLC (“Company,” “we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of our websites, applications, and affiliated platforms, including MyNewRental.com, the My New Rental Investor Marketplace, and AppFolio Tenant/Owner Portals (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

1. About Our Services

My New Rental, LLC is a licensed Florida real estate brokerage that provides:

Property listings and investment opportunities through the Investor Marketplace.
Property management and leasing services for property owners and residents.
Related communications, alerts, and digital services to clients, investors, and residents.

The Services may include features that integrate with third-party systems, such as Salesforce, Titan, and AppFolio.

2. Eligibility

You must be at least 18 years of age to use our Services.
By using the Services, you represent and warrant that:

All information you provide is accurate, complete, and current.
You have the legal capacity to enter into binding agreements.
You will comply with all applicable laws and regulations.

3. Account Registration & Access

Certain areas of the Services may require registration or account creation.
You agree to:

Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorized use of your account.
Accept full responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate access for violations of these Terms or misuse of our Services.

4. Property Listings & Investment Opportunities

Listings, pricing, pro formas, and projections displayed on our platform are for informational purposes only and are subject to change without notice.

Property availability, pricing, and investment returns are not guaranteed.
All transactions are governed by the specific terms outlined in individual Purchase Agreements or Assignment Contracts.
For certain Wholesale or Direct-Seller opportunities, My New Rental acts as principal or intermediary, not as a fiduciary agent.
Investors are responsible for performing their own due diligence before entering into any transaction.

5. Fees & Payments

Applicable marketplace and transaction fees are disclosed prior to contracting.
All payments, deposits, and closing funds must be made in accordance with the executed property contract and closing instructions.

By using our Services, you authorize title and escrow partners to disburse applicable marketplace or documentation fees to My New Rental, LLC as reflected on final settlement statements.

6. Communications & Opt-In Consent

By creating an account, submitting a form, or engaging with our Services, you consent to receive electronic communications from My New Rental, LLC.
These may include:

Account notifications, reminders, and support communications.
Property alerts, promotions, and investor opportunities.
SMS text messages, subject to opt-in and frequency preferences.

Message frequency varies based on activity and settings.
Message & data rates may apply. Reply STOP to cancel or HELP for assistance.

7. Brokerage, Representation & Non-Circumvention

For Turnkey / Build-to-Rent properties, My New Rental may act as a licensed real estate broker.
For Wholesale or Direct-Seller properties, no brokerage representation is created.

Users of the Investor Marketplace agree not to circumvent My New Rental, LLC in any transaction introduced through the platform.
Unauthorized direct contact with sellers, builders, or related parties is a violation of our Non-Circumvention Policy and may result in liquidated damages as stated in your Investor Participation Agreement.

8. Intellectual Property

All content on our websites — including text, graphics, images, software, data, and logos — is owned by or licensed to My New Rental, LLC and protected by copyright, trademark, and other laws.

You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

9. Disclaimers

All Services, property information, and communications are provided “as-is” and without warranties of any kind, either express or implied.

My New Rental, LLC does not guarantee:

The accuracy, completeness, or reliability of listings or projections.
Future investment performance or returns.
The availability or condition of any listed property.

You agree that your use of our Services is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, My New Rental, LLC, its affiliates, and representatives shall not be liable for any indirect, incidental, or consequential damages arising from your use of our Services or participation in any transaction.

In no event shall our aggregate liability exceed the total fees paid to My New Rental, LLC for the specific transaction giving rise to the claim.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida.
Venue for any dispute shall lie exclusively in Sarasota County, Florida.

You agree to attempt resolution through good-faith discussions before pursuing formal legal action.

12. Updates to These Terms

We may modify these Terms from time to time. Updates will be reflected by the “Last Updated” date above. Continued use of our Services after changes constitutes acceptance of the revised Terms.
